When you create your account, you agree to these Terms of Service and Site Agreement.
If you share the account information with others, they are also bound
by this agreement.
Your use
of our site is acceptance by you of the terms and conditions in this Agreement.
Changes & Updates
Changes and updates will be made to this site constantly. Occassionally, we will
update this document. If major changes are made, you will receive an announcement
in your My Account page. Your continued use of this site, is your agreement to abide
by these changes.
Enable Communication
Freight Exchange Online is an example of technology that helps enable better business. Our
technology enables shippers and truckers to communicate quickly and effectively
to move freight from Point A to Point B. Our technology also helps alleviate profit sucking
Deadheading. Agreements between Shippers and Truckers connected through this site
is strictly between those companies. FXC does not
act an an intermediary in any way.
- We do not handle settlement
- We do not handle logistics
- We do not address on time issues
- We do not handle damages, demands or contract disputes.
You get the picture. We hook you up, you do the rest. Please do not involve us in
any dispute you may have with one of your fellow FXC members.
It it is our goal to facilitate the exchange of useful information online to help
enable to you to do what you do better.
Serving You
Post your freight or your truck, search for freight or a truck, it's that simple. You may not copy, reproduce, compile, or use in any way any of the truck or load information found at Freight
Exchange Online.com. We have no advertising, no links to other sites. Seems like
there are enough of those already. Use our services to fill your truck or move your
freight.
Intellectual Property Rights
All text and images found on this site are the sole property of FXC. You may not
use or reproduce text or images for any reason at any time.
Subscription levels
We offer three subscription levels to serve your needs.
Account Types
Sign up with Freight Exchange online today. Fill your trucks, transport your loads.
No Pop-Ups, EVER! One month free.
Trucker/Carrier Account - $35.00
Post your available trucks and view available loads for a monthly subscription
fee of $35.00.
Shipper/Broker Account - $35.00
Post your available loads and view available trucks for a monthly subscription
fee of $35.00.
Combo Account - $50.00
Post, edit and view both trucks and loads for a monthly subscription fee of $50.00.
Payment Authorization
FXC uses PayPal for settlement for our subscription services. Through PayPal, you
may choose a variety of options to pay for your FXC Subscription. If you do not
have a PayPal account, you may sign up for one at the end or our account creation
process. FXC does not know or hold any of your banking information. We do not know
your bank
account numbers or your credit card numbers. Cancellation of services
is also through PayPal. Your 'My Account' page has a 'Cancel' options that takes
you to PayPal and searches for your FXC Subscription.
Use of this site, is your authorization to charge your PayPal account montly services
you have chosen. All fees and charges are non-refundable. Your subscription privileges
begin on the day you create your account, and end on the day you cancel your account.
We offer a Try Before You Buy, account. The date of your first charge will be shown
to you in your PayPal account.
Changes to the price structure will be emailed to the account holder's email address
at least 45 days before the change takes effect.
Your Protection
This site has been built for your use. Your continued use of this site is contingent
upon following the rules as laid out in this agreement. Failure to follow these
rules may result in the termination of your account. The termination of any
account is at the sole discretion and judgement of Freight Exchange Online.
Limitation of Liability
By using our service, you acknowledge that Freight Exchange Online is merely an online service which provides information and data. As such, all information provided on this site is provided on an Aas is, as available@ basis. Because much of the information is provided or generated by our users, we cannot make any representations as to the accuracy of that user-generated content and we assume no liability or responsibility for inaccuracies, errors, or omissions in such content. Furthermore, as a user of our site, you understand that you do so at your own risk. Freight Exchange Online does not warrant that our site will operate without error. Nor can we warrant that the site or its servers are free of computer viruses or harmful content. As a user, you agree that you will not duplicate, copy, compile, republish, or resell any information on our site or do anything that would hinder the operations of our site.
Because the services provided by us are as is, as available@, we make no warranty or condition of those services whether express or implied. THEREFORE, TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, FREIGHT EXCHANGE ONLINE SPECIFICALLY AND EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
By using Freight Exchange Online, you expressly agree that you will not hold Freight Exchange Online and its subsidiaries, affiliated companies, employees, contractors, officers, and directors liable for lost profits or any other damages as a result of the use of our site, including but not limited to direct, indirect, punitive, incidental, special, or consequential damages. However, if it is determined that we are liable, you agree that our liability is limited to the fees paid by you to us in any one month. Furthermore, by using our site, you specifically and expressly agree to indemnify Freight Exchange Online and hold Freight Exchange Online harmless from all damages resulting from claims made by any third party against Freight Exchange Online to any authorized use or misuse of our site including but not limited to our reasonable attorney fees.
Finally, by using our site, you specifically agree that no relationship, agency, partnership, joint venture, employee-employer, or franchisee-franchisor relationship is created or arises from this agreement of use or your use of the site. Rather, our relationship is that of independent contractor and nothing more.
